Terms of Service

1. Purpose and acceptance

These terms of service (hereinafter "Terms") govern the use of the GVA Horizon mobile application and all its associated services.

By creating an account or using the service, you accept these Terms in their entirety. If you do not accept these conditions, you must not use the application.

Use of the application is restricted to persons aged 16 or older.

This English version is a convenience translation. In case of discrepancy, the French version prevails.

2. Service description

GVA Horizon is an intelligent urban assistant for Geneva. The service is built on three pillars:

• Personalised morning briefing: a daily summary tailored to your profile, covering weather, transport, air quality, events and local news
• ASK chatbot: a conversational assistant powered by artificial intelligence, able to answer your questions about life in Geneva
• Smart push notifications: relevant and personalised alerts based on your preferences and context

The service also offers gamification features, personalised alerts, contextual scenarios and participatory signals.

GVA Horizon is available on iOS (App Store) and Android (Google Play).

3. User account

• Only one account per person is permitted
• You must provide accurate information when registering
• You are responsible for the security of your login credentials
• Email address verification is mandatory
• You can delete your account at any time from the application, which triggers a cascading deletion of all your data

4. Premium subscription

• Price: CHF 9.90 per month
• Payment: via Apple In-App Purchase (iOS) or Google Play (Android)
• Renewal: automatic monthly renewal
• Cancellation: via the App Store or Google Play settings (cancellation cannot be done from the GVA Horizon application)
• Refunds: subject to the respective policies of Apple and Google

The premium subscription provides access to the following features:

• Data export
• Unlimited alerts
• Unlimited ASK (unrestricted questions)
• Personal insights
• Custom scenarios

5. Use of artificial intelligence

The ASK chatbot uses artificial intelligence (Anthropic Claude) to generate responses.

Important:

• Responses are informational and general in nature
• They do not constitute professional advice (legal, medical, financial or safety)
• GVA Horizon does not guarantee the accuracy, completeness or timeliness of generated responses
• You must verify important information with official sources
• Briefing summaries are generated by AI and may contain inaccuracies

6. User content and participatory data

By using participatory features (place reports, border reports, real-time signals, block feedback), you agree that:

• Place reports are anonymised after 24 hours and deleted after 7 days
• You grant GVA Horizon a non-exclusive, royalty-free, worldwide licence to use your participatory data for the operation and improvement of the service
• Publishing false, misleading or harmful content is prohibited
• GVA Horizon reserves the right to remove any content that violates these Terms

7. User obligations

By using GVA Horizon, you agree to:

• Not abuse the service (spam, harassment, scraping, reverse engineering)
• Not create multiple accounts
• Not disrupt the operation of the service
• Not use the service for illegal purposes
• Comply with applicable Swiss law

Any breach of these obligations may result in the suspension or termination of your account.

8. Intellectual property

The GVA Horizon application, its brand, design and content are protected by Swiss copyright law (Federal Act on Copyright, CopA) and applicable international conventions.

Third-party data (weather, transport, events) remains the property of their respective sources.

Any reproduction, distribution or creation of derivative works is prohibited without prior written authorisation from GVA Horizon.

9. Personal data

The processing of your personal data is governed by our Privacy Policy, accessible from the application.

Your data is stored in Switzerland and processed in compliance with the nFADP and, where applicable, the GDPR. You have rights of access, rectification, erasure and portability, detailed in the Privacy Policy.

10. Service availability

The service is provided "as is" and "as available".

GVA Horizon does not guarantee uninterrupted availability of the service. The service may be suspended or modified for maintenance, updates or improvements.

Prior notice will be provided when reasonably possible.

11. Limitation of liability

• Information provided by GVA Horizon is for informational purposes only
• GVA Horizon is not liable for decisions made based on information from the application
• The accuracy of third-party data is the responsibility of the source providers
• GVA Horizon is not liable for indirect, incidental or consequential damages
• The total liability of GVA Horizon is limited to the amount paid by the user in the preceding 12 months
• These limitations apply to the extent permitted by Swiss law

12. Suspension and termination

By the user:

• Account deletion at any time from the application

By GVA Horizon:

• Suspension or termination for violation of the Terms, abuse or illegal activity
• Notification by email

Effects of termination:

• Loss of access to the service
• Deletion of data in accordance with the retention policy

13. Force majeure

Neither party shall be held liable for failure to perform its obligations in the event of force majeure, including but not limited to: natural disasters, pandemics, government actions, infrastructure failures or interruptions of third-party services.

14. Modification of terms

GVA Horizon reserves the right to modify these Terms.

You will be notified of changes by push notification or within the application.

Continued use of the service after the effective date of changes constitutes acceptance of the new Terms.

If you disagree with the new Terms, you may delete your account.

15. Governing law

These Terms are governed exclusively by Swiss law.

16. Jurisdiction

Any dispute relating to these Terms shall fall under the exclusive jurisdiction of the courts of the Canton of Geneva (Tribunal de premiere instance), subject to mandatory provisions regarding the user's place of domicile for consumer protection purposes.

17. Severability

If any provision of these Terms is declared invalid or unenforceable, the remaining provisions shall remain in force. The invalid provision shall be replaced by a valid provision whose effect most closely approximates the objective pursued by the original provision.
