1. Purpose and acceptance

These terms of service (hereinafter "Terms") govern the use of the GVA Horizon mobile application and all its associated services.

By creating an account or using the service, you accept these Terms in their entirety. If you do not accept these conditions, you must not use the application.

Use of the application is restricted to persons aged 16 or older.

This English version is a convenience translation. In case of discrepancy, the French version prevails.

GVA Horizon is an intelligent urban assistant for Geneva. The service is built on three pillars:

Any breach of these obligations may result in the suspension or termination of your account.

8. Intellectual property

The GVA Horizon application, its brand, design and content are protected by Swiss copyright law (Federal Act on Copyright, CopA) and applicable international conventions.

Third-party data (weather, transport, events) remains the property of their respective sources.

Any reproduction, distribution or creation of derivative works is prohibited without prior written authorisation from GVA Horizon.

The processing of your personal data is governed by our Privacy Policy, accessible from the application.

Your data is stored in Switzerland and processed in compliance with the nFADP and, where applicable, the GDPR. You have rights of access, rectification, erasure and portability, detailed in the Privacy Policy.

The service is provided "as is" and "as available".

GVA Horizon does not guarantee uninterrupted availability of the service. The service may be suspended or modified for maintenance, updates or improvements.

13. Force majeure

Neither party shall be held liable for failure to perform its obligations in the event of force majeure, including but not limited to: natural disasters, pandemics, government actions, infrastructure failures or interruptions of third-party services.

GVA Horizon reserves the right to modify these Terms.

You will be notified of changes by push notification or within the application.

Continued use of the service after the effective date of changes constitutes acceptance of the new Terms.

If you disagree with the new Terms, you may delete your account.

15. Governing law

These Terms are governed exclusively by Swiss law.

16. Jurisdiction

Any dispute relating to these Terms shall fall under the exclusive jurisdiction of the courts of the Canton of Geneva (Tribunal de premiere instance), subject to mandatory provisions regarding the user's place of domicile for consumer protection purposes.

17. Severability

If any provision of these Terms is declared invalid or unenforceable, the remaining provisions shall remain in force. The invalid provision shall be replaced by a valid provision whose effect most closely approximates the objective pursued by the original provision.
